Absent other context you're not going to jail for flipping someone's hat, but technically yes it is. So I don't know how it will shake out if Sneako presses charges. On one hand the guy was "surrounded" by "racists" who were supposed to be leaving, but he also had the high ground and clearly wasn't in any danger, and went totally apeshit.
